HOUSTONSMEDICALOFFICESPACE.com GENERAL TERMS AND CONDITIONS (May 2010)
The submission of information to, and use of, the real estate information services (collectively, the "Service") available through the Houston's Medical Office Space web site (located at http://houstonsmedicalofficespace.com) is subject to the following terms and conditions (the "Terms and Conditions" or the "Agreement"). BY SUBMITTING INFORMATION to, or accessing information from, the Service, YOU, the end user customer ("Customer") AGREE TO THE FOLLOWING TERMS AND CONDITIONS.
If you do not agree to these Terms and Conditions, do not submit information to, or access information from, the Service. All questions concerning this Agreement should be directed to: The PV Group, General Manager, P.O. Box720286, Houston, TX 77272-0286. HoustonsMedicalOfficeSpace.com may update these terms and conditions at any time and without notice. The latest version of the terms and conditions is available on the HoustonsMedicalOfficeSpace.com website.
Customer agrees to pay for all products ordered through the HoustonsMedicalOfficeSpace.com site or via the HoustonsMedicalOfficeSpace.com sales team using the payment method indicated, and provides HoustonsMedicalOfficeSpace.com express authorization to charge said fees to the Customer's payment provider at time of purchase or renewal.
Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid for by Customer. If payment is not current, HoustonsMedicalOfficeSpace.com may immediately cease to provide any and all Deliverables to the customer.
Payments made for monthly products are non-refundable, regardless of whether the agreement is terminated prior to the end of the then-current monthly billing period. Prepaid fees will be refunded based on the number of months remaining on the contract period, beginning with the month following receipt of written cancellation, but may be subject to adjustment according to current monthly product pricing and subject to adjustment for any incentives or discounts provided for said prepayment. No partial month refunds will be provided.
Customers have the option of automatic renewal using the Customer's current credit card account number unless Customer cancels their agreement by written notice via email sent to MyAccount@HoustonsMedicalOfficeSpace.com or mailed to Houstonís Medical Office Space, Customer Service Dept., P.O. Box720286, Houston, TX 77272-0286, three (3) days prior to the renewal date to cancel such agreement. All cancellation requests will be processed within five (5) business days. Once the cancellation is processed, a confirmation email or letter will be sent via the customer's email account or mailing address on record with HoustonsMedicalOfficeSpace.com. If Customer has a question about a cancellation, Customer should contact AdServices@HoustonsMedicalOfficeSpace.com . HoustonsMedicalOfficeSpace.com reserves the right to change its fees or billing methods at any time. HoustonsMedicalOfficeSpace.com will provide timely notice to the affected Customers of any such changes.
It is the Customer's responsibility to promptly provide the HoustonsMedicalOfficeSpace.com with any contact or billing information changes or updates (including phone number, email address, credit card numbers, etc.). Account updates should be sent to MyAccount@HoustonsMedicalOfficeSpace.com, or Customer Service Dept., P.O. Box720286, Houston, TX 77272-0286. HoustonsMedicalOfficeSpace.com does not validate all credit card information required by the Customer's payment provider to secure payment.
Submission and Administration of Listings
Customer agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each Property's data to HoustonsMedicalOfficeSpace.com unless the Customer has received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish and advertise the Property on the Customer's website or on HoustonsMedicalOfficeSpace.com's website.
Customer agrees to maintain accurate contact information (specifically, a valid phone number and email address) in order to submit and maintain active property listings on the HoustonsMedicalOfficeSpace.com website.
HoustonsMedicalOfficeSpace.com shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on the HoustonsMedicalOfficeSpace.com website and it shall have the right to modify the property listing in the exercise of its rights under this Agreement.
The Customer (a) represents and warrants that all Properties and associated information provided by the Customer will be accurate; (b) agrees that the Customer will not permit the posting of a property on HoustonsMedicalOfficeSpace.com under a name other than the named licensed real estate agents that have been engaged by the property owner to market the property under the terms of a duly executed listing agreement with the owner; (c) agrees to administer the Properties provided by the Customer and maintain their accuracy at all times.
HoustonsMedicalOfficeSpace.com reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the HoustonsMedicalOfficeSpace.com website. The Company accepts no responsibility for checking the accuracy of reports or information submitted by the Customer.
In order to maximize the features of the HoustonsMedicalOfficeSpace.com service, customers should note certain parameters in the listing process.
HoustonsMedicalOfficeSpace.com is a web site for commercial real estate suitable or potentially suitable for medical practices. Listing of single-family residences or commercial real estate that has no potential as a medical facility is prohibited on the HoustonsMedicalOfficeSpace.com website. Any listing deemed unsuitable will not be allowed during the listing approval process and an email will be sent to the Customer stating that the property has been identified as a non-medical property.
Listing Quantity, Submission, and Display
Advertisers may list an unlimited number of listings on HoustonsMedicalOfficeSpace.com - according to details of the advertising package or product they purchased.
Use of Photographs
Building photographs posted, attached, or affixed to listings must be actual photographs of the building being listed. All such photographs must be either (a) the property of the listing broker or (b) the listing broker must have received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish such photographs on the Customer's website or on HoustonsMedicalOfficeSpace.com's website for the purpose of advertising the subject property. Appropriate photographs that are not directly related to the building or property being listed, including brokerage company logos are permissible at the discretion of HoustonsMedicalOfficeSpace.com.
Listings on HoustonsMedicalOfficeSpace.com are for properties that are currently offered for Sale or Lease. However, it is permissible to post listings on the Service that have already been sold or are no longer on the market, i.e. posting listings on the Service for marketing or advertising purposes ("Billboard Listings"). However, all listings for properties already sold or off-market will be labeled as such.
Use of profanity or vulgar language in any section of the HoustonsMedicalOfficeSpace.com database is strictly prohibited. This includes the use of language that is generally considered obscene, profane, sexual, hateful, or racist in nature. Listing or user information that includes profane language will be removed from the HoustonsMedicalOffice.com immediately.
